GTC: Language course

General

This registration is valid only for the given months, weeks, or hours.

  • Each Lesson lasts 45 Minutes.

  • Payment for lessons is due before the beginning of the course.

  • For unattended lessons there are neither refunds nor extra sessions.

  • We reserve the right to cancel lessons in duly justified exceptional cases. If it is not possible for to give alternative lesson dates or to internally compensate. We do not refund part of the payment for the unattended classes. Further claims will not be accepted as long as there is no proof of violation of the contract.

  • For cancellations of already booked courses, three working days’ notice is required before the course starts. We charge a cancellation fee 50 Euro for labour costs. If the cancellation comes later than the given deadline or the participant does not show up to the lesson, the whole fee costs are due. Proof of high or low damages are possible.

  • Rebooking

    Rebooking is only possible latest 14 days before the trip –when the course begins we charge a rebooking charge of 50€ for labour costs. The same fee will be due by a rebooking depending on the place where the course will take place or when you bring forth a suitable substitute as replacement.

    Cancellation for German study tours

    Cancellation is possible anytime before the beginning of the trip.
    To avoid any misunderstandings, we recommend notifying us of a cancellation in writing.
    Booked travel arrangement cancellation fees:
    30 days before the course begins: 10%
    15 days before the course begins: 25%
    7 days before the course begins: 40%
    6 days or less before the course begins: 75%
    Absence on the course, without any prior notification, will mean that the whole amount of the travel / course payments is due. The right to prove higher or lower damages is possible. The court of jurisdiction: Düsseldorf.

    Other terms of conditions for special types of courses.

    Evening courses

    After the end of a booked lesson month you do not need to register again, because your registration is automatically extended on a monthly basis as long as we have received no formal notice of termination of language contract. If you change your mind about continuing a language course, please do not forget to cancel your contract in writing. The notice period of the termination of a contract is 4 weeks to the end of the course month. For intensive or single lessons, no letter of termination is required.

    One month of teaching consists of four weeks, in which the course takes place.

    In the event of a lesson cancellation due to holidays, we make an effort to come to an agreement between the course participants and the trainers to offer extra class sessions. However, this means that the initial duration of the course will be prolonged.

    For unattended lessons there are no extra sessions. You are required to produce a medical certificate if absent, within three days of illness or sickness occurring, before the course begins. Vacation-related absence in an on going course (evening courses) will be refunded with additional classes on these conditions:

    a) If the vacation is longer than 2 weeks
    b) If we receive notification of vacation plans 2 weeks before the course, it will be credited on the following conditions: with 3 class cancellations one double lesson, with 4 cancellations 2 double lessons, with 5 cancellations 3 double lessons and so on.

    Booked group courses can only take place when we the course has enough participants.

    Single Lesson

    Planned dates for single lessons must be cancelled 48 hrs before the course starts, if not the lessons will not be credited.

    In case of longer non-attendance, booked and paid for lessons and the refund charges are forfeited at the end of two years.

    Educational leave

    Application for and the taking up of educational leave for participation in a language course is binding. Out of the office times are to be given to the school administration and employer.

    Rebooking of (Dates, Course, and Language) must be done immediately and in written form at the latest within 3 weeks before the course begins. For cancellations at short notice (less than 3 weeks) then point six of the general terms and conditions apply. This also applies when the employer does not accept the appointed dates for educational leave. In this case, we need to receive a copy of the corresponding notification from the employer. A rebooking exemption from charges can be made twice within the period prescribed, further changes will be accompanied with a charge of 50 €.

    GTC: Study tours

    Registration

    We recommend registering as soon as possible. Please use our registration form to apply. The contract will be drawn up upon registration approval. We will confirm your registration in writing.

    Educational leave

    On our registration form, check yes on the line “book as educational leave/ Bildungsurlaubsbestätigung erwünscht.” Once we receive your registration, we will send a confirmation in writing to present to your employer. Your employer is obligated to grant permission for educational leave following the legal regulations. In case your company can not grant permission for your booked date, inform us before the three week deadline after receiving our verification so we can rebook with no charge to you. Please send a copy of the corresponding notification from the employer. Changes made after the three week deadline on receiving confirmation, rebooking or cancelling, will be charged a rebooking fee or a cancelation fee (see paragraph 5 and 6). Additionally, you will receive a certificate for your employer upon course completion.

    Payment

    We ask that 10% of the trip costs, or 250€ per participant, be paid within a week of receiving our booking confirmation and/or bill. This will be then subtracted from the rest of your bill. The premium for an insurance package or cancelation insurance is not covered in the travel price and is due with the down payment. Your payment for the trip costs are after § 651k paragraph 3 BGB an insolvency insurance policy. You will also receive a travel price document with the booking confirmation/bill. The remaining cost is due three weeks before the departure date. The travel documents can either be sent to you or you can pick them up at SPRACHCAFFE. In order to pay by credit card, send a completed credit card payment form with a copy of both sides of the credit card and a copy of a ID card or Passport of the card holder. An additional 2 % credit card administration fee will be charged.

    Language levels

    There is no compensation for unexcused absences. Our school offers many different language levels. Placement in the correct learning level in group courses can only occur on site on the first day of class. Therefore, it can not be fully ruled out, that the placement test results may conclude that there are not enough participants in a group course for a certain language level on the first day. In this case, the school would offer the course as (semi-) private lessons with reduced class time, in which at least 60% of the booked group course time would be offered as (semi-) private lessons (instead of a 20 hour teaching unit of group courses, a 12 hour unit of (semi-) private lessons; instead of a 30 hour teaching unit of group courses, an 18 hour unit of (semi-) private lessons). In every case it involves an “upgrade,” an increase in quality, without additional charge.

    Performance, lack of Performance

    The scope of the contractual services is restricted to the performance description in the catalogue and the details referring to these in the confirmation/invoice are binding. Collateral agreements or amendments altering the scope or price of a contractual service shall not be made except as expressly agreed in writing. Complaints regarding the services should be reported so that immediate corrections can be made. Should the customer fail to report an error, and SPRACHCAFFE does not have the opportunity to remedy the shortcomings, then there will be no price reduction.

    Performance and price changes

    Any changes to or deviations from the individual services specified in the agreed contract of caused by bad faith are permitted, as long as they are not substantial and do not compromise the overall arrangement.

    If the period of time between the completion of the travel contract and beginning of travel exceeds four months, we reserve the right in the frame of legal admissibility to change the travel costs. This could be due to an increase in the transportation costs or the duties imposed on certain services, such as port or airport fees or a change of the exchange rates that are applicable to the booked tour. A revision of prices may be possible depending on how the changed cost factors affect the travel cost after the completion of the contract. We are obligated to inform the participant of price changes up until the 21st day before the agreed departure date. Price alterations after this time are not permitted by law.

    In case of an increase of more than 5 % of the price of the trip or a considerable change of a substantial service included, it is possible to terminate the contract or, in case of an admissible termination by us, the participant has the right to a trip of at least the same value, if we are able to offer such a tour. The participant is obligated to exercise these rights immediately after being notified of the change. We recommend notifying us in writing.

    Cancellation

    Cancellation is possible anytime before the beginning of the trip. To avoid any misunderstandings, we recommend notifying us of a cancellation in writing. If you cancel before the start of your travel, we are entitled to demand appropriate reimbursement for our travel provisions and costs. When calculating compensation, we take the customarily saved expenses and customary potential savings from alternative utilisation of the travel services into account. SPRACHCAFFE’s compensation due to cancellation is based on the receipt date of the cancellation notice and the total cost of the trip. In general, the fixed cancellation rates, which we have to request per registered participant in the event of a withdrawal, are as follows. You have the right to prove that the expenses incurred are less than the cancellation fee.

    Booked travel arrangement cancellation fees:
    At least 30 days before date of departure: 30%
    From the 22nd to the 29th day before date of departure: 40%
    From the 15th to the 21st day before date of departure: 50%
    From the 7th to the 14th day before date of departure: 60%
    6 days or less before date of departure: 70%
    On the date of departure, no show, or after the departure date: 90% of the total travel expenses.

    The contractual partner also has the right to prove that the claim for damages is less as a result of the delay. Bookings without travel arrangements have the following cancellation fees:
    At least 45 days before the date of departure: 15%
    From the 30th to the 44th day before the date of departure: 40%
    29 days or less before the date of departure: 70%
    On the date of departure, no show, or after the departure date: 90%
    of the total expenses.
    You have the right to prove that the expenses incurred are less than the cancellation fee.

    SPRACHCAFFE may terminate the contract without notice if the tour member is persistently disruptive or violates the contract in such a manner that an immediate termination of the contract is justified. SPRACHCAFFE retains the right to the travel price, but may eventually credit the participant for expenses incurred.

    Trip cancellation rates

    The cancellation fee will be reimbursed in the event that you are unable to travel do to unexpected sickness or severe accidental injury. You are required to pay a 20% deductable of the cancellation fees, as long as no necessary in-patient hospital treatment was the reason for cancellation.

    Rebooking

    Changing a booking (e.g. arrival date, language course, participant, accommodation, etc.) within 31 days of departure will incur a fee of 50 €. We will do our utmost, but cannot guarantee the fulfilment of the request made as extra costs may incur. In that case, the rebooking charge may exceed 50€.

    Flight rebookings

    The rebooking of a flight before the departure date is only possible at an additional charge, because the offered flights are at a special rate. The flight can no longer be rebooked after the date of departure.

    Passport and Visa conditions

    The travel organizer notes the laws and regulations for the destination country in the travel catalogue and the travel documents.

    It is assumed that the traveller is a German citizen and does not have any special conditions that would cause the visa to be declined. Citizens of other countries should contract their consulate for more information.

    Liability

    Customer’s claims due to travel deficiencies are subjected to a one year limitation period according to § 651 c - 651 d BGB. The limitation period shall begin on the day on which the trip on the travel contract should have ended. The enforcement of other claims for damages generally remain unaffected.

    Voidability of travelling conditions

    Should the following travelling conditions be invalid or not admissible, this does not have any significant effect on the existence of the other remaining travelling conditions.

    Court of Jurisdiction

    Place and court of jurisdiction for Sprachcaffe Reisen GmbH is Frankfurt/Germany. In other cases the legal provisions apply.
